PSAR & C.A.R. Oppose Bill to "End Run" Licensing Requirements

C.A.R. is OPPOSING an 11th hour attempt to create a new exemption to state real estate licensing requirements. C.A.R. is asking state senators to vote NO on AB 1381, which will be considered by the Senate as soon as TODAY.

AB 1381, a bill that was originally designed to address issues with appraisers, was JUST amended to allow those who represent outdoor advertising companies and those representing the landowners they lease from to perform the same duties as REALTORS®, but WITHOUT a license, simply by creating a partnership or corporation. Unfortunately, with this amendment, C.A.R. is forced to oppose the entire bill.

Talking Points:

  • The Process is Flawed. It is inappropriate to carve out a new exemption to the real estate licensing law at the very last hour, intentionally avoiding having the measure fully vetted by a policy committee.  
  • The Policy is Flawed. Under the new proposed language, any individual can create a partnership or company and avoid the license requirement for agents that negotiate extremely valuable leases, and sales, on behalf of third parties.  The change allows unlicensed agents to evade the recently enacted commercial agency disclosures (enacted only last session); it also allows unlicensed agents to evade the fiduciary responsibilities that would apply to any other legitimate agent.
